Activist faces jail time for using a privacy phone

On January 8th, 2026, French activist Noah Laurent was charged with 'obstruction of legal surveillance' following a police raid on his home, and is now facing three years in prison simply for using GrapheneOS, a hardened, privacy-focused, and encrypted version of Android. +

 +

Laurent, a 24-year-old French activist based in Leon, was arrested earlier this morning following a raid conducted by EUROPOL and French authorities without a warrant. According to court documents obtained by The Agentic Cloud, Laurent's phone, a Pixel device running GrapheneOS, was seized as "evidence of deliberate obstruction." +

 +

GrapheneOS is an open-source operating system designed to strip out Google's tracking, harden security, and reduce the amount of data sent to third-parties. It is widely used by journalists, activists, security professionals, and others who require strong privacy and security protections, or just ordinary people who want extra digital privacy. +

 +

"Apparently, wanting to protect your digital sovereignty is now a crime in France," Laurent said. He has been released on parole but must appear in court next month. "I never thought I'd be arrested simply for wanting to protect my data." +

 +

The charge itself, "obstruction of legal surveillance," is quite frightening. The fact that French authorities can choose to arrest a person simply for using a privacy-focused operating system under a technicality of legislation is certainly uncalled for. +

 +

Representatives of activist group La Quadrature du Net commented on the story: +

 +

"It is quite frightening that people can be arrested simply for wanting privacy, a basic human right. This is a direct assault on digital sovereignty. If using encryption is a crime, then France has declared war on its own citizens." +

 +

The French Ministry of Digital Affairs stated that "While we respect individual privacy, certain operating systems are designed specifically to evade lawful surveillance. This is not about censorship; it is about national security." +

 +

French authorities have received massive backlash from privacy activists, calling it a dangerous precedent. The European Digital Rights Association (EDRi) has begun investigating the case, though they have not yet issued a formal statement. +
